Terms of Service

1. Acceptance of terms

By accessing or using Brieform (“the Service”) at brieform.app, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notice.

2. Description of service

Brieform provides an AI-powered form builder that allows users to create, customize, publish, and collect responses from web forms using natural language. The Service is currently in beta and features may change or be discontinued.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at dany@brieform.app if you suspect unauthorized access.

You may not create accounts on behalf of others without permission, or create multiple accounts to circumvent usage limits.

4. Acceptable use

You agree not to use the Service to:

• Collect personal data without proper legal basis or consent from respondents
• Create forms designed to deceive, defraud, or phish users
• Distribute spam or unsolicited communications
• Violate any applicable law or regulation (including GDPR, CCPA, CAN-SPAM)
• Infringe on intellectual property rights of third parties
• Attempt to reverse-engineer, scrape, or attack the Service infrastructure
• Use the Service for illegal activities of any kind

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion.

5. Your content and data

You retain full ownership of all forms you create and all responses collected through your forms. By using the Service, you grant Brieform a limited, non-exclusive license to store and process your content solely to provide the Service.

You are solely responsible for the content of your forms and for ensuring you have the right to collect any data requested from respondents. Brieform does not review form content and is not liable for how you use collected data.

6. Intellectual property

The Brieform name, logo, software, AI models, and service infrastructure are owned by Brieform and protected by intellectual property laws. Nothing in these Terms transfers any IP rights to you.

You may not copy, modify, distribute, or create derivative works based on the Service without prior written permission.

7. Beta service and availability

The Service is currently in beta. We provide it “as is” and make no guarantees of uptime, data durability, or continued availability of any particular feature. We will make reasonable efforts to provide advance notice of major changes or shutdowns.

8. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. BRIEFORM DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRIEFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF BRIEFORM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100 USD.

10. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account for violations of these Terms, with or without notice. Upon termination, your data will be deleted within 30 days.

11. Governing law

These Terms are governed by the laws of the European Union (France) without regard to conflict of law principles. Any disputes shall be resolved in the courts of Paris, France, unless applicable law requires otherwise.
